This Policy describes the Company practices with respect to Personal Information the Company collect. Floatbot use of data is governed by our customer agreements covering access to and use of those offerings.

This Policy is applicable to all those who uses or visits the Platform, or anyone else related for that matter. The users are bound by the terms of use of the Company. This Policy applies only to information collected, processed and used through the Platform. This Policy does not apply to information collected through other channels, such as information collected offline, from other Platforms or from emails. International Transfers of Personal Data

Your Personal Data will be collected, transferred to, and stored by us in the United States or by our affiliates in other countries where we operate. In the event that your Personal Data is processed outside the European Economic Area (EEA), we will ensure that the recipient of your Personal Data offers an adequate level of protection by entering into an agreement to abide by Standard Contractual Clauses for the transfer of data as approved by the European Commission (Art. 46 GDPR), or another mechanism approved by the EU.

Our application also provides option of referral and hence shall enable collection of referral email id, phone number etc. However, user entering such PII on behalf of the referral shall completely hold consent of the referral for such act and any liability that may arise on us for using such referral’s PII for marketing or otherwise, shall have to be completely indemnify us by you.

Certain areas and features of the website are available to you without the need to provide us with any information. However, other features of the Site or the Service will require providing the website with details such as your name, email address, address, mobile number etc., personally identifying information, a username and a password (collectively the “Registration Information”). There are no user IDs & passwords of any government or other institution asked on the platform. Any of your information that has been availed from any third party, basis on this consent, shall be used only in accordance with specific internal procedures as well as the statutory stipulations and safeguards governing access, in order to operate, develop or improve the service.

Before you disclose to us the personal information of another person, you must obtain that person's consent to both the disclosure and the processing of that personal information in accordance with this policy. In case of any discrepancies and/or issues arising due to such “on behalf” submission, the submitter shall be liable and obligated under the then existing PII and other applicable rules and regulations.

  • Cookies and electronic tools
    To improve the working and operation of the Platform, certain cookies or electronic tools will be used on the Platform to collect information to make the experience user-friendly. Cookies are small files that contain letters and numbers which may be placed on the device of the users when they visit a Platform or an app. “Cookies” are pieces of information that may be placed on the user’s device by a service provider for the purpose of facilitating and enhancing user communication and interaction with that Service. The Platform uses cookies to enhance the experience of the user when he/she uses the Platform. This helps the Company to remember user preferences.   • Log File Information
    The Platform automatically collects limited information about the user’s computer to the Internet, including the IP Address, computer’s name, the operating system, browser type and version, CPU speed, and connection speed. The Platform will use “clear GIFs” (Web Beacons) to track the online usage patterns of the users in an anonymous manner, without personally identifying the user. The Platform will also use clear GIFs in HTML-based emails sent to the users to track which emails are opened by recipients. The Platform will use this information to inter-alia deliver the web pages to the users upon request and to measure traffic within the Platform to improve the quality, functionality and interactivity of the Platform.
  • Device Information
    The Platform will collect information about the devices the user uses to access the Platform, including type of device, operating system, settings, and unique device identifiers, and IP address. The Platform either collects all or some of this information depending upon what type of device is being used and its settings.

To make sure that the user’s personal data is secure, the Company communicates the privacy guidelines to the employees and strictly enforce privacy safeguards within the Company.

OPTING OUT

We provide our registered customers with periodic emailers and email/SMS alerts. We also allow users to unsubscribe to email newsletters and from time to time may transmit emails promoting the company or third-party goods or services. The company's subscribers may opt-out of receiving our promotional emails and terminate their newsletter subscriptions by following the instructions in the emails. Opting out in this manner will not end transmission of service-related emails/SMS, such as email/SMS alerts.

D. HOW INFORMATION IS USED BY THE COMPANY

The information supplied by the users helps the Platform to improve the services provided by it and to provide the most user-friendly experience. The information provided by the user is used to provide the user with personalized content including the services as required. This is done by using the previous search/browsing history of the user to determine relevant search results. It is also used to customize and improve the features, performance and support of the Platform. The information is used to provide relevant advertising, interest-based advertising of the Company and third parties. The Platform, under no circumstance, will share a user’s personal information for marketing purposes, unless consented by user from time to time.

The information provided by the users also helps the Platform to conduct its internal operations, including troubleshooting, data analysis, testing, research, and service improvement. The information collected for this purpose may include the IP address of the user and mobile device information to help diagnose problems with the services provided by the Platform and to administer the Platform adequately. The Platform makes use of the user information to create aggregate and statistical data for improving the commercial prospects of the Company. When the Platform collects any information that does not identify the user as a specific natural person (“Non-Personal Information”), the Company is permitted to use and disclose this information for any purpose, notwithstanding anything to the contrary in this Policy, except where the Company is required to do otherwise by applicable law. Examples of Non-Personal Information include: physical location information; Demographic information, including ZIP codes, etc.; or any anonymous personal information, aggregated or de-identified. Further, user consents to use the data in accordance to anonymization and pseudonymization under GDPR.

By submitting personal information, the user agrees to storing, processing and transferring of personal information by the Company. However, the company is inclined towards the safety of the users and to ensure this, the Company will take all reasonable steps to ensure that the user’s personal information is treated securely and in accordance with this Policy. Most importantly, the Company has implemented industry standard security measures to protect the personal data of the users. When data is saved in application it will automatically transferred to a secured server via encrypted channel. When a user tries to retrieve data from server, it will be routed through an encrypted channel and displayed on the user’s device.

WARNING: The information collected and stored via the internet is not and cannot be completely secured and the Company cannot guarantee the security of all personal information fully submitted by the users. Any and all transmission is at the risk of the users. The user agrees and acknowledges the risk involved before registering or using the Platform.

E. INFORMATION SHARING AND THIRD PARTY DISCLOSURES

The Company shares user information with any third party without obtaining the prior consent of the user in the following limited circumstances:

a. When it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including but not limited to cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing the Policy or for complying with the applicable laws and regulations.

c. As and when the Company may otherwise deem necessary and is permitted by applicable laws to protect and defend the rights, the users, or third parties; or as permitted under applicable laws to meet national security and similar requirements.

d. The Company may use the contact information of the user, in order, to send users mail or other communications regarding updates at the Platform or potential services that may be offered. The Company may also provide additional communications, promotions and information on advertisers or anything else which may be of interest to the user. The nature and frequency of these messages will vary depending upon the information that the Company has obtained about the users.

In cases of reorganization or sale of assets of the Company, all user information will be transferred, subject to the acquirer and its affiliates accepting the commitments made in this Policy and compliance with other applicable laws. The Company may transfer information about the users, if the Company is acquired by or merged with some other entity. In this event, the Company will notify all its users before such transfer and becomes subject to a different Policy.

Although the Company is committed to protecting the privacy of its users, the Company cannot guarantee that all the personal information or private communications of the users will always remain private. As a user of the Platform, the user must understand and agree that he/she/it shall assume all responsibility and risk for his/her/its use of the Platform, the internet generally, and for the documents posted or accessed and for his/her/its conduct on and off the Platform. A user’s account may be visible to other users/visitors on the Platform. However, it is the responsibility of the user to make sure that the users or third party do not get unauthorized access to his/her/its account.

The Company will not rent, sell or share the personal information of the users with any other entity for its own marketing purposes under any circumstances publicly or anonymously. F. CHOICE REGARDING PERSONAL INFORMATION

The Company will make use of the user’s email address to send notifications to the user, only to the extent of what the user has opted-in for promotional communications. Such personal data is provided by the user during the time of registration. The Company will send service-related announcements to the user whenever it is deemed to be necessary. Generally, the user cannot opt-out of these announcements, which are not primarily promotional in nature. If the user does not wish to receive these announcements, he/she/it has the option to deactivate his/her/its account.

i. How to deactivate user account
If a user wishes to deactivate its account with the Platform, he/she/it can do so by sending an email at connect@floatbot.ai. Once the account is deactivated, the user will no longer have full access to the Platform and personal information such as Phone Number; Profile Picture; Date of Birth that was provided, shall be unlinked.

ii. Security Safeguards
The Company has implemented several commercially reasonable technical, administrative and organizational measures as well as certain physical, electronic, and managerial measures to secure personal information of the users from accidental loss and from unauthorized access, use, alteration or disclosure. However, due to the inherent open nature of the Internet and wireless communications, the Company cannot guarantee that the personal information of users will be completely free from unauthorized access by third parties, when transferred over or through systems not within the exclusive control of the Company.

The user is responsible for ensuring that personal login credentials (username and password) are kept confidential. The user is asked to create a unique and strong password for one’s account and it should not be used for any other web services or applications. The password must not be shared with anyone else. The Company will take appropriate security measures for protection against unauthorized access to or unauthorized alteration, disclosure or destruction of data.

By availing the services provided by the Platform, the user assumes the risk of providing personal information. The Company guarantees compliance with the requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Children’s Online Privacy Protection Act of 1998 (COPPA) and the California Consumer Privacy Act of 2018 (CCPA) regarding the protection and preservation of private data and to ensure maximum privacy to the users of the Platform. The Company will NOT do with personal information in the scope of acting as a service provider, as defined by CCPA:

We will verify your request using the information associated with your account, including email address. Consumers can also designate an authorized agent to exercise these rights on their behalf.

G. TIPS FOR RESPONSIBLE USE OF THE PLATFORM

The Company will actively monitor the Platform for activities that violate its Terms & conditions. If any fraudulent activity is detected, the user’s account will be removed immediately. However, fraudulent activity can sometimes appear and all users are urged to exercise caution in their usage of the Platform. Please consider the following tips when conducting availing the services of the Platform:

  1. The user must not send money to anyone and should give out personal or financial account information to any other user via email or through the Platform.
  2. The user must be aware of accounts that asks for personal/sensitive information which might be inappropriate and suspicious.
  3. The user should not include sensitive personal information in the personal account.

H. IPR OWNERSHIP

You shall not copy, modify, transmit, distribute / re-distribute, reverse engineer etc., but not limited to, or in any way exploit the Products or any other copyrighted materials and content provided other than for your individual training. Any other purpose is expressly prohibited under these terms. You shall also not permit anyone else to copy, use, modify, transmit, distribute or in any way exploit the Products or any other copyrighted materials, trademark / registered mark, the designs, innovations, business ideas etc., which together shall be known as IPR and the ownership of the same belongs to the company. Any infringement, theft etc., of the IPR of the company shall result in criminal proceedings against you at your risk, cost and consequences.

You will not (and will not allow any third party to) attempt to copy, record or reverse engineer any Videos or Documentation supplied by Company or stored on the website (or related) websites, outside the application in any manner.

I. PRIVACY OF MINORS

Every user must be of 18 years of age or above to avail the services of the Platform. If any person is under the age of 18 years, his/her use of the Platform must be under the supervision or approval of a parent or guardian or any other adult.

The Company understand the importance of safeguarding the personal data of children, which the Company considers to be an individual under the age of 18 or the equivalent age as specified by law in the user’s jurisdiction (“Children” or “Child”). The Company supports the Children’s Online Privacy Protection Act (“COPPA”) and follow the guidelines. The Company do not knowingly collect, use or share personal data from Children unless the Company obtain verifiable parental consent or a COPPA exception applies. If the Company learns that a children's personal data was collected without appropriate authorization, it will be deleted as soon as possible

J. UPDATES/AMENDMENTS TO THE POLICY

This Policy is subject to updates from time to time. The revised Policy will be effective immediately for users registering accounts or otherwise acknowledging the Policy on or after the revision date. For other users who registered accounts before the revision date, it will also become effective immediately. However, they can object to the new Policy within thirty (30) days after the revision date. If changes which materially reduces the rights or increases responsibilities of the users are made, the users will be notified by email (sent to the email address specified in the user’s account) prior to the change becoming effective. L. CONTACT US

We will only process the data you submit via the contact form in order to contact you. As long as we have received your contact data, which you provide via the contact form, only for this purpose, we will not use this personal data for any other purposes. Apart from cases in which we are legally obliged to do so, we will not pass on your contact data to third parties in this case.

Nine (9) months after sending the reply, we will delete the data you have transmitted via the contact form, unless we are legally obliged to keep it for a longer period of time or we still need your personal data for the implementation or processing of an existing contractual relationship or for verification purposes. In such a case, we will delete the relevant data after the legal retention period has expired or as soon as we no longer require the data for the implementation or processing of an existing contractual relationship or for verification purposes.

Revocation of consent

You have the possibility to revoke your consent to the processing of your personal data for the future at any time within the scope of the legal regulations. THE USER IS THEREFORE ADVISED TO RE-READ THE POLICY ON A REGULAR BASIS. SHOULD IT BE THAT THE USER DOES NOT ACCEPT ANY OF THE MODIFICATIONS OR AMENDMENTS TO THE TERMS OR POLICY, THE USER MAY TERMINATE HIS/HER/ITS USE OF THIS PLATFORM IMMEDIATELY. THE COMPANY WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR DISCLOSURE OF INFORMATION OF THE USERS DUE TO ERRORS IN TRANSMISSION, UNAUTHORIZED THIRD-PARTY ACCESS, OR OTHER CAUSES BEYOND OUR CONTROL. THE ONUS OF PROTECTING THE CLASSIFIED/ PERSONAL INFORMATION DETAILS OF EVERY USER SOLELY DEPENDS ON THEM AND THE COMPANY SHALL TAKE NO LIABILITY IN CASE OF ANY BREACH THEREUPON. THE COMPANY SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE SUSTAINED BY REASON OF ANY DISCLOSURE (INADVERTENT OR OTHERWISE) OF ANY INFORMATION CONCERNING THE USER’S ACCOUNT OR FOR ANY ERROR, OMISSION OR INACCURACY WITH RESPECT TO ANY INFORMATION SO DISCLOSED AND USED WHETHER OR NOT IN PURSUANCE OF A LEGAL PROCESS OR OTHERWISE.
